This document sets out the terms governing access to and use of the Platform Fewgoodhumans.com / fewgoodhumans app (‘Platform’) by any user, customer, visitor, purchaser, renter, patient, family member, attendant requester, or other person using the Platform (“User”). By accessing or using the Platform, the User agrees to be bound by these Terms and conditions of use, which together with our privacy policy govern Few Good Humans Service Private Limited’s relationship with you in relation to this Platform. If you disagree with any part of these terms and conditions, please do not use our Platform.

The term Few Good Humans Service Private Limited or ‘us’ or ‘FGH’ or ‘we’ refers to the owner of the Platform whose registered office is A 498, Fourth Floor, Cyber Park, Sector 67, Bhondsi, Gurgaon 122102, Haryana, India.

1. Nature of the Platform

The Platform is a technology-enabled marketplace and aggregator that facilitates discovery, comparison, booking, scheduling, communication, payment support, delivery coordination, and related technology services in connection with third-party medical attendants, caregivers, nurses, technicians, and third-party suppliers, sellers, lessors, installers, and service providers of medical equipment and related products or services.

Unless expressly stated otherwise in writing, the Platform is not a hospital, clinic, nursing home, ambulance service, pharmacy, medical practitioner, manufacturer, seller of record, or direct provider of healthcare treatment. The Platform operates in the capacity of an intermediary or marketplace in relation to third-party listings, service requests, and equipment offerings, subject to applicable Indian law.

2. Independent Third-Party Service Providers

All attendants, caregivers, nurses, technicians, equipment vendors, rental partners, logistics providers, repair personnel, installers, and similar providers available through the Platform are independent third parties unless specifically identified as employed directly by the Platform in writing. The Platform does not create any partnership, employment, agency, fiduciary, joint venture, or representative relationship with such third parties merely by listing, onboarding, enabling booking, or processing payments for them.

The User understands that the actual caregiving, bedside support, patient handling, equipment operation, repair, installation, maintenance, and any professional or technical service is performed by the relevant third-party service provider, and not by the Platform.

3. No Medical Advice

The Platform does not provide medical advice, diagnosis, treatment, prescription, clinical supervision, or emergency response. Any content, descriptions, support messages, call-centre scripts, FAQs, product specifications, blogs, educational material, or communications made available through the Platform are for general informational and transaction-facilitation purposes only and must not be treated as medical advice or as a substitute for consultation with a qualified registered medical practitioner.

The User is solely responsible for obtaining appropriate medical advice before hiring any attendant, caregiver, nurse, or technician, or before renting, purchasing, installing, or using any medical equipment or consumable.

4. No Guarantee of Outcome or Suitability

The Platform does not guarantee the competence, skill, legality, timeliness, licensure, registration, availability, conduct, behaviour, response time, bedside manner, quality, or fitness of any third-party service provider. The Platform also does not guarantee that any equipment, device, consumable, or accessory listed on the Platform will be appropriate, error-free, uninterrupted, compatible, clinically suitable, or fit for any specific patient, diagnosis, therapy, or home-care environment.

Any on-boarding, KYC verification, document collection, credential review, ratings, inspections, or background verification undertaken by the Platform is limited in scope, may rely on third-party records or self-declarations, and does not amount to certification, guarantee, warranty, or assumption of clinical or technical responsibility by the Platform.

5. User Responsibility

The User shall provide complete and accurate information regarding the patient’s age, diagnosis, mobility, medications, allergies, infection risks, home setup, caregiver needs, equipment requirements, and all other information relevant to service delivery. The User shall ensure that the home environment is reasonably safe, accessible, hygienic, and suitable for the requested attendant or equipment service.

The User shall use all equipment strictly in accordance with manufacturer instructions, product manuals, safety directions, and professional advice, and shall not misuse, alter, tamper with, or allow unauthorized persons to operate the equipment. The Platform shall not be liable for any loss arising from inaccurate information, non-disclosure, misuse, unauthorized modification, negligence at the User’s location, or use contrary to instructions.

6. Emergency Disclaimer

The Platform is not an emergency care provider. In any medical emergency, acute deterioration, breathing difficulty, collapse, severe pain, uncontrolled bleeding, or similar urgent event, the User must immediately contact emergency services, a hospital, or a qualified medical practitioner. The Platform shall not be responsible for any death, injury, deterioration, or delay arising from the User’s reliance on the Platform in an emergency situation.

7. Equipment Disclaimer

Medical equipment and related products listed on the Platform may be supplied, rented, installed, serviced, or maintained by third-party sellers, lessors, distributors, or manufacturers. Unless expressly stated in writing, the Platform does not manufacture, calibrate, test, refurbish, prescribe, or clinically validate such equipment. Product images, descriptions, specifications, and compatibility information may be supplied by third parties and may contain inaccuracies, omissions, or updates.

The User is solely responsible for verifying product suitability, compatibility, prescription requirements, intended use, voltage and space requirements, and proper installation needs. Claims relating to product defect, manufacturing defect, hidden defect, calibration issue, equipment failure, installation error, or maintenance lapse shall lie primarily against the relevant manufacturer, seller, lessor, installer, or service provider responsible for that equipment.

8. Platform Availability

The Platform is provided on an “as is” and “as available” basis. The Platform does not warrant uninterrupted access, real-time availability, error-free performance, security, availability of any particular third-party service provider, or availability of any particular equipment item, even if previously shown on the Platform.

9. Limitation of Liability

To the fullest extent permitted under applicable law, the Platform, its affiliates, promoters, directors, officers, employees, agents, contractors, licensors, and technology providers shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential loss or damage, including loss of profit, loss of business, loss of opportunity, loss of goodwill, emotional distress, pain and suffering, or cost of substitute service or equipment, arising out of or in connection with the use of the Platform or any third-party service or equipment booked, rented, or purchased through it.

Without prejudice to the foregoing, the Platform shall not be liable for any injury, infection, fall, negligence, misconduct, assault, omission, delay, service deficiency, clinical deterioration, death, incorrect patient handling, equipment misuse, equipment malfunction, manufacturing defect, delayed installation, failed repair, shortage, or other act or omission attributable to any third-party service provider, vendor, manufacturer, installer, or logistics partner.

To the fullest extent permitted under applicable law, the total aggregate liability of the Platform for any and all claims arising out of or relating to the Platform or these Terms, whether in contract, tort, negligence, statute, or otherwise, shall not exceed the lower of: (a) the amount of platform fee, convenience fee, or commission actually retained by the Platform for the specific transaction giving rise to the claim; or (b) INR 10,000.

Nothing in these Terms shall exclude or restrict liability to the extent such exclusion is prohibited by applicable law, including any non-waivable rights of consumers under Indian law.

10. Indemnification by User

The User agrees to defend, indemnify, and hold harmless the Platform, its affiliates, promoters, directors, officers, employees, agents, service providers, and licensors from and against any and all claims, actions, proceedings, demands, damages, losses, liabilities, costs, penalties, settlements, and expenses, including reasonable legal fees and expenses, arising out of or related to:

  • the User’s breach of these Terms;
  • the User’s misuse of the Platform;
  • inaccurate, false, incomplete, or misleading information submitted by the User;
  • misuse, improper handling, unauthorized use, or unsafe storage of any equipment;
  • violation of applicable law by the User;
  • injury to any third party caused by the User or at the User’s premises;
  • any claim brought by a patient, family member, attendant, neighbour, landlord, or third party arising out of conditions at the User’s premises or the User’s instructions.

This indemnity shall survive suspension, termination, expiry, or discontinuation of the User’s relationship with the Platform.

11. Indemnification by Service Partners, Vendors and Sellers

Every third-party attendant provider, caregiver partner, nursing agency, technician, vendor, seller, lessor, distributor, installer, logistics provider, maintenance provider, and other service partner using the Platform shall, under a separate partner agreement, indemnify, defend, and hold harmless the Platform and its affiliates against any and all losses, claims, liabilities, damages, penalties, actions, costs, and expenses, including legal fees, arising from or relating to:

  • negligence, gross negligence, misconduct, fraud, wilful default, or unlawful acts;
  • personal injury, death, patient harm, abuse, or property damage;
  • licensing, registration, qualification, labour law, tax, or regulatory non-compliance;
  • breach of applicable healthcare, consumer, device, product, data, or commercial laws;
  • defective goods, manufacturing defects, hidden defects, maintenance failures, installation failures, or calibration issues;
  • breach of representations, warranties, service levels, or platform onboarding obligations;
  • intellectual property infringement or misuse of third-party rights;
  • claims by employees, contractors, patients, hospitals, insurers, regulators, or consumers.

The Platform may require such partners to maintain adequate insurance and furnish documentary proof of the same as a condition of onboarding or continued listing.

12. Complaints and Grievances

The User may raise complaints in accordance with the grievance redressal mechanism published on the Platform. The Platform may, in its discretion and without admission of liability, facilitate complaint forwarding, response coordination, replacement, cancellation, refund support, investigation, temporary suspension, or removal of listings, subject to applicable law and platform policies.

The existence of a complaint handling process does not create any representation that the Platform is the direct service provider or manufacturer of any listed service or equipment.

13. Right to Remove, Suspend or Share Information

The Platform reserves the right to suspend, block, delist, remove, restrict, or report any User, listing, content, account, or transaction if required by law, to comply with lawful directions, to reduce risk, to investigate complaints, or where the Platform reasonably believes there may be fraud, abuse, safety concerns, regulatory risk, or misuse of the Platform.

The Platform may share information with competent authorities, law enforcement agencies, regulators, courts, insurers, or dispute-resolution forums as required under applicable law or as reasonably necessary to protect legal rights and safety.

14. Payment, Fees and Taxes

The User agrees to pay all service fees, consulting fees and other fees applicable to User’s use of Services and the User shall not circumvent the fee structure. The fee is dependent on the package that User purchases and not on actual usage of the Services.

Each User / member is solely responsible for payment of all taxes, legal compliances, and statutory registrations and reporting. FGH is in no way responsible for any of the taxes except for its own income tax.

The fees could be paid online through the facility made on the Website. Third parties support and services are required to process online fee payment. FGH is not responsible for any loss or damage caused to User during this process as these third parties are beyond the control of FGH. The fees could also be paid offline and be either collected personally from the User.

All fees are exclusive of applicable taxes.

FGH reserves the right to modify the fee structure by updating the fee structure on the Website which shall be considered as valid and agreed communication.

In order to process the payments, FGH might require details of User’s bank account, credit card number, etc.

15. Force Majeure

The Platform shall not be liable for any delay, disruption, unavailability, rescheduling, cancellation, or failure in performance caused by events beyond its reasonable control, including natural disasters, epidemics, pandemics, war, cyber incidents, power failure, internet failure, transport disruptions, labour shortages, governmental orders, supply chain disruptions, or acts or omissions of third-party providers.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to applicable consumer law, courts having jurisdiction over Gurgaon, Haryana, India shall have exclusive jurisdiction over disputes arising out of or in connection with these Terms.

17. Savings Clause

If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. Any provision that is unenforceable in part shall be enforced to the maximum extent permissible under law.

18. General

The content of the pages of this Platform is for your general information and use only. It is subject to change without notice.

This Platform is designed to store your medical and demographic data.

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this Platform for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Your use of any information or materials on this Platform is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this Platform meet your specific requirements.

This Platform contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

All trademarks reproduced in this Platform, which are not the property of, or licensed to the operator, are acknowledged on the website.

Unauthorised use of this Platform may give rise to a claim for damages and/or be a criminal offence.

From time to time, this Platform may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).

Your use of this Platform and any dispute arising out of such use of the website is subject to the laws of the Republic of India.

19. Acceptance

By accessing, registering on, browsing, or using the Platform, the User confirms that the User has read, understood, and agreed to these Terms.
